This case arose out of a collision between the defendant's tractor-trailer and a Mazda Miata operated by the plaintiff's decedent.

The decedent, who had recently lost his position as a mid-level executive, was traveling in the right lane of U.S. 421 North, a divided four-lane highway, near Winston-Salem.

The defendant tractor-trailer, which was traveling in the same direction, struck the decedent's vehicle causing it to lose control. The decedent, who was the vehicle's only occupant, was killed in the accident.

The decedent was survived by his wife and their two children, ages 21 and 18.

The case settled after mediation and before trial.
